Smith has spent close to 30 years on death row in Alabama after being convicted of kidnapping, robbing and killing a woman named Sharma Johnson in 1991. Johnson was the sister of a prominent Birmingham police detective.
Smith’s attorneys say he suffers from an intellectual disability, has an IQ score of around 70 and thus a 2002 Supreme Court ruling should render his execution unconstitutional. As of now, Smith’s execution date is set for Oct. 21. Veteran death penalty lawyer Kelley Henry joins Tewolde to discuss Smith’s case and how the Supreme Court ruling is seemingly being ignored as judges consider whether to vacate it.
