1:06:38Now PlayingAround 1:29 AM on March 18, 2025, Officer Clayton Smiley with the Athens-Clarke County Police Department observed a blue 2015 Mercedes-Benz C55 driving at a high rate of speed while headed eastbound on Clayton Street. The driver also changed lanes without signaling. Based on the traffic infractions, he activated his emergency lights to initiate a traffic stop. The driver pulled over in the parking lot of the Truist Bank on East Broad Street. Officer Smiley then exited his patrol car and made contact with the driver, who was identified as 21-year-old Sofia Bombaloff-Moncher.
As he was speaking with Sofia, Officer Smiley detected an odor of alcohol and observed other indicators of impairment. Sofia admitted to consuming 2 drinks earlier that evening. Since Officer Smiley suspected that Sofia was impaired, she was asked to perform field sobriety exercises.
The first exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Officer Smiley observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn test. During the Walk and Turn test, Sofia failed to maintain her starting position. The final exercise was the One Leg Stand test. During the One Leg Stand test, Sofia failed to raise her foot in the proper fashion and did not count in the correct sequence.
Based on her traffic infractions, the odor of alcohol, her indicators of impairment, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily perform the field sobriety exercises, Sofia was placed under arrest for DUI. After placing her under arrest, Officer Smiley read her the Georgia Implied Consent Notice at the scene, and she agreed to submit to a breath test.
Sofia was first transported to their downtown substation for the administration of the breath test. Sofia’s breath test results indicated a BAC level of 0.13%, which was over the legal limit of 0.08%. After the breath test was complete, Sofia was transported to the Clarke County Jail.
She was booked into the Clarke County Jail and issued the following summonses:
-DUI – Alcohol (40-6-391(a)(1))
-DUI (40-6-391(a)(5))
-Too fast for conditions (40-6-180)
-Improper lane change (40-6-123(a))
-Reckless driving (40-6-390(a))
Sofia was eventually released on a $1,861 bond pending her court appearance. On November 18, 2025, Sofia pleaded guilty to 40-6-180 and 40-6-123(a), while she was nolle prossed for her DUI tickets. As a result of her convictions, Sofia was sentenced 12 months of probation on 2 counts and 40 hours of community service. She was also required to pay a total of $1,339 in fines.
