In Florida, an individual has a statute of limitations for different types of cases. In injury cases, the statute of limitations is four years. If someone passes away prior to being able to file their claim, the Florida wrongful death act allows an estate to stand in the shoes of the person who passed away. They then have the right to bring that claim on behalf of the injured party who passed away, presuming that that cause of action has not a re-run.
