Today is supposed to be the last hearing before Karen Read's trial is schedule to start on April 1st. There are several loose ends to be addressed, including:

The Commonwealth's newly-filed motion to access Karen's texts with David Yanetti between January 29 and February 2, 2022

Ruling on the defense's motion to dismiss for extraordinary government misconduct

The jury questionnaire and other logistics

Outstanding rulings on numerous other issues including reconsidering Dr. Crosby, most of the motions in limine, and the defense's challenge to Dr. Welcher

Also, Karen's motion for a stay of her trial to the First Circuit remains pending.

The issue of Karen's texts is likely to be where the fireworks fly tomorrow. On the one hand, the Commonwealth may have waited too long - the first interview they rely on to argue she waived attorney-client privilege took place nearly two years ago, and they have already filed their certification of compliance indicating discovery is complete. On the other hand, Judge Cannone has a history of hostility to the defense team's publicity efforts and may see this motion as vindication and a tempting opportunity to say "I told you so."
