In Atlanta, Fulton District Attorney Fani Willis loves to use RICO charges, or the Racketeer Influenced and Corrupt Organizations Act. RICO was orginally created to target the Mafia and other organized criminal enterprises in the 1970’s. Going forward, however, RICO allowed prosecutors to charge any groups of people or corporations together as part of a conspiracy, like drug cartels, street gangs, or corrupt businesses. Essentially, the charges can move beyond just the individual committing crimes and show larger patterns.
RICO provides longer prison sentences and larger fines and gives prosecutors a way to incentivize individuals lower in the ‘gang’ to provide information and rat out their leaders. Further, it can be used to punish and hold liable people who participated in a scheme or actively participated in the criminal enterprise, even if they did not directly commit the act.
Willis in Georgia loves to use these chargers, sometimes for good and sometimes for evil. She’s thrown RICO charges at Altanta public school teachers, YSL’s Young Thug and Gunna, as well as Cop City protesters. Now, she may use them against Donald Trump. We discuss how and why Trump and his co-conspirators may get RICO’d.
