7:49Now PlayingRoger Rogoff was sworn in as the U.S. attorney for the Western District of Washington after federal judges unanimously appointed him under the law.
Fifty-four minutes later, Donald Trump fired him by email.
Now Rogoff is suing Trump, acting Attorney General Todd Blanche, and the Justice Department, arguing that his removal was unlawful. He is asking a federal judge to reinstate him until the position is filled through the normal process of presidential nomination and Senate confirmation.
The case raises a larger constitutional question: can the president fire a U.S. attorney appointed by federal judges under a law passed by Congress — and can the administration keep removing every replacement until it gets someone it personally approves?
The Justice Department says the judges failed to consult with the administration and that Trump’s authority to remove Rogoff is “wholly” within presidential power. Rogoff’s attorneys argue that the firing undermines Congress’s constitutional authority and leaves the people of Western Washington without a validly appointed top federal prosecutor.
