In the past decade it has become far more dangerous to take the streets as states, the FBI, along with private corporations have criminalized all kinds of forms of protest. Actions that were once simple misdemeanors like blocking traffic, are in many states being classified as felonies.
This wasn’t always the case as journailst Adam Federman explains. While surveilling activists has always been part of what the FBI does, making protest illegal and finding ways to undermine it began to take on a more sinister framework right around the opposition to the Keystone XL pipeline. It was then that private energy companies teamed up with law enforcement to ensure that peaceful demonstrations were met with brute force, and that the consequences for participating in such actions meant a permanent stain on one’s record.
Federman notes that anti-pipeline organizing has been classified as eco-terrorism, as if there were anything remotely similar between things like mass shooters or bombers and Native elders holding feathers in the faces of police officers. He notes that the criminalization of protest became turbo-charged by the Black Lives Matter movement in the summer of 2020, ironically a movement demanding police reform.
All of this has come to a head in Atlanta, Georgia where Cop City protesters are now facing RICO charges for things like distributing fliers or holding fundraisers, as if they were part of drug cartels or…the Trump administration.
