What’s clear is that the American culture and political system professes to love babies but hates pregnant people. If you’re in legal trouble for exercising your right to choose, or having a miscarriage, many states will now be able to use all their resources in order to fully prosecute you.
Even with legal aid organizations that are fighting the criminalization of abortion rights, there is so much stacked against pregnant people from accessing their basic dignity. If it isn't the doctors and the medical system, it’s the far- right attorneys general and other elected, or it’s the media who are all out to demonize you. Ultimately very few people have the privilege or ability to be locked in a legal battle for months and months on end, to say nothing of what it means for them trying to seek a safe termination of their pregnancy. We can move to underground support systems, but what truly needs to happen is a codification of abortion rights on a national federal level. We need real political leadership.
We invited Rafa Kidvai, the Director of If/When/How's Repro Legal Defense Fund, to discuss what that might look like to those involved.
